That would certainly be the legal justification. The area had an established use pattern preceeding the expansion of the park boundaries by a good 20+ years. Just as certain grandfathered-in mining rights are allowed within the park, the expansion of the park boundary can not erase the community that was coopted when the boundary moved.
As for someone's right not to see the body in its natural state, there's no law against averting one's eyes.
